Unter welchen Bedingungen immaterielle Anlagewerte handelsund steuerrechtlich bilanzfahig bzw. bilanzpflichtig sind, ist umstritten. Klare gesetzliche Regelungen fehlen; es bleibt in letzter Instanz der ludikatur iiberlassen, was man z. B. unter 'rechtsahnlichen Werten und sonstigen Vorteilen' ( 244 Abs. 2 Satz 2 HGBE) zu verstehen hat. In der ludikatur lassen sich, wie auch in der Literatur, zwei Grundpo sitionen erkennen: der Versuch einer vollstiindigen bilanziellen Erfassung aller immateriellen Anlagewerte und die entgegengerichteten Bestrebungen, immate rielle Anlagewerte im Interesse der Rechtssicherheit nur bei ausgepragter Konkreti sierung bilanziell zu beriicksichtigen. Solange man glaubte, die Verwirklichung von Bilanzwahrheit scheitere vor allem an der vollstandigen Erfassung immaterieller Anlagewerte, neigte man zur ersten Grundposition; heute weiB man, daB eine umfas sende Beriicksichtigung von (nur willkiirlich bewertbaren) immateriellen Wirt schaftsgiitem des Anlagevermogens die Bilanzwahrheit mehr geflihrdet als fOrdert. Deshalb hat man im Aktiengesetz 1965 die Bilanzierung immaterieller Anlagewerte sehr stark eingeschrankt, und der Bundesfinanzhof ist dieser Tendenz in ganz ausge pragter Weise gefolgt. Das neue Bilanzrecht bedeutet (auch) insoweit einen Schritt zuriick; die Diskussion um die Bilanzierbarkeit immaterieller Anlagewerte muB auf einer breiten Ebene neu beginnen. In dieser Situation wird sich die vorliegende Arbeit als sehr bilfreich erweisen: die Analyse der h6chstrichterlichen Finanzjudikatur zeigt, daB auch bier im Grunde alles Gescheite (und alles weniger Gescheite) schon einmal gedacht wurde; darauf laBt sich zuriickgreifen. Es gibt in der Betriebswirtschaftslehre eine Reihe von wichtigen Arbeiten zu den Aktivierungsgrenzen.
