Mehrwertdienste, also Handyleistungen, die nicht nur Telefonie bzw. SMSVersand sind; dafr wird aber auch ein entsprechend hheres Entgelt verlangt. Die modischste Form ist hier das Bestellen eines speziellen Klingeltons, wie es mittlerweile berwiegend auf allen Musiksendern in der Werbung vorgemacht wird . Diese Form der Werbung, die sich auch in namhaften Printmedien fr Kinder und Jugendlichen wieder findet, richtet sich auch speziell an diese Personengruppe. Wettbewerbrechtlich knnte hier deshalb ein Versto gegen 3, 4 Nr. 2 UWG vorliegen, weil es den Minderjhrigen suggeriert, durch die Bestellung des Klingeltons zu einer coolen Szene" zu gehren, und dadurch die geschftliche Unerfahrenheit auf sittenwidrige Weise ausgenutzt wird . Insgesamt wird hier aber ein besonderer Minderjhrigenschutz nicht oder zumindest nicht effektiv gewhrt, sodass auf Vorschriften des BGB zurckgegriffen werden muss.
