Nach Gehlen handelt es sich bei diesen um ein ,,Gefge sozialer Normen, an denen wir uns in unseren Handlungen zu orientieren haben''. Unter diesen Begriff fallen daher alle sozialen Gruppen, Freundschaften, Arbeitsgemeinschaften und die Familie. Institutionen sind aber auch der Staat und das Rechtssystem, die groe Auswirkungen auf das Dasein des Einzelnen haben knnen. Vor allem das Rechtssystem liefert wichtige Grundlagen zum menschlichen Zusammenleben. So sind erlaubte Handlungen in Gesetzen festgeschrieben. Werden diese von jemandem berschritten, erfolgt eine Verhaftung, ein Gerichtsverfahren, ein Urteil und zuletzt die Verwahrung des Schuldigen. Dabei wird auf allen Stufen durch zum Beispiel vorzulegende Beweise beim Gerichtsverfahren oder durch das Recht, einen Rechtsvertreter benennen zu drfen, darauf geachtet, dass dem Gefangenen kein Unrecht widerfhrt und Gerechtigkeit hergestellt wird. Ein solches Rechtssystem wird in Kafkas Institutionenroman ,Der Proce' vorgestellt. Ob dieses allerdings ebenso, wie oben dargestellt, ,gerecht' urteilt, ist die Fragestellung dieser Hausarbeit. Es soll geklrt werden, ob es sich bei dem Machtapparat in Kafkas Roman um eine totalitre Institution handelt, die willkrlich verhaftet, verhrt und urteilt. Eine solche besteht, wenn sie fr sich einen idealen Machtapparat darstellt. Um der Frage der Hausarbeit auf den Grund gehen zu knnen, muss zunchst diskutiert werden, ob es sich bei Kafkas Roman berhaupt um einen Institutionenroman handelt. Dafr ist es vonnten zu Wissen, was Institutionen sind und wie sie entstehen. Dabei wird auf den Institutionsbegriff von Gehlen zurckgegriffen. Infolgedessen wird
