Product DescriptionSchon seit Beginn der Bundesrepublik Deutschland besteht ein Spannungsverhltnis zwischen dem im Grundgesetz Artikel 38 (1) verankerten Recht des Abgeordneten, seine Entscheidungen seinem Gewissen entsprechend zu treffen, ohne an Auftrge und Weisungen gebunden zu sein, und dem Anspruch der Fraktion genau dieses einzuschrnken. Im Kontext der historischen Entwicklung und den im Grundgesetz verankerten und verfestigten Werten, den sich daraus ergebenden Verhaltenserwartungen sowie den damit verbundenen Normen und Normengefgen hat sich diese Studienarbeit zur Aufgabe gemacht jedenfalls soweit dies der Rahmen zulsst zu untersuchen, ob und inwiefern ein Prozess von Normverselbststndigung stattgefunden hat bzw. gerade stattfindet. Die Fragen, die dabei von zentraler Bedeutung sind, lauten: Knnen sich Normen oder Normengefge so weit von ihrem ursprnglichen Zweck entfernen, knnen sie eine Eigendynamik entfalten, die sich letztendlich gegen die Menschen und ihre Interessen wendet? Oder ist dieser Prozess vielmehr eine Notwendigkeit, ein Anpassungsprozess? Wann wird eine Norm zur Gefahr? Diese Fragen versucht diese Arbeit am Beispiel von Artikel 38 (1) GG versus dem Fraktionszwang auf den Grund zu gehen.About the AuthorEva Mertens wurde 1963 in Hamm (Westfalen) geboren.1984 schloss sie die Schule mit der Allgemeinen Hochschulreife ab. Es folgte nach einem viersemestrigen Studium an der Musikhochschule Detmold (klassischer Gesang), welches aus gesundheitlichen Grnden abgebrochen werden musste, eine Ausbildung zur Bankkaufrau. Berufliche Erfahrungen konnte Frau Mertens auch auerhalb des Bankensektors sammeln. Sie arbeitete mehrere Jahre als selbststndige Vermgensberaterin und einige Zeit im Immobilienbereich. Situationsbedingt zeigte sie Flexibilitt und gab Gesangs und Blockfltenunterricht, arbeitete sowohl mit Kindern als auch mit Erwachsenen. 2007 entschloss sich die Autorin eine zweite Ausbildung in Form eines Lehramtsstudiums aufzunehmen, welches sie im Juli 2012 mit dem ersten Staatsexamen erfolgreich abschloss. Bereits 2009 nahm sie ihr Forschungsprojekt mit dem Namen 'AniMaProjekt Teil I' auf, das 2012 sein Ende in der Verffentlichung ihrer Fachbcher fand.
