Am 1. Januar 1991 ist das UmwHG in Kraft getreten. Es ist ein Reformwerk, das die rechtliche Drdnung des zivilen Haftungsrechts auf neue Rechtsgrundlagen stellt, an die wiederum weitreichende umweltpolitische Hoffnungen und Erwar tungen geknupft werden. Db das Gesetz entsprechende Einschatzungen rechtfer tigt, hangt wesentlich yom Verstandnis der Regelungsinhalte abo Der vorgelegte Kommentar will dazu einen Beitrag leisten. Er wird in einer Phase vorgelegt, in der zwar noch keine forensischen Erfahrungen mit der Gesetzesanwendung gemacht wurden, aber zahlreiche Stellungnahmen aus Rechtswissenschaft und Rechtspraxis zum Inhalt und zur Bedeutung des UmwHG vorliegen. Sie konnten bis Ende Februar 1993 berucksichtigt werden. Das UmwHG stellt sicherlich keinen Endpunkt der Entwicklung des zivilen Umwelthaftungsrechts dar. Die Deckungsvorsorgeverordnung, auf die die 19ff. UmwHG abstellen, ist derzeit noch nicht erlassen. Sie wird erheblichen EinftuB auf die Gestaltung der Versicherung von Umwelthaftungsrisiken haben. Die Um setzung der EGUmweltinformationsrichtlinie in nationales Recht mit ihren Kon sequenzen auf die Auskunftsanspruche nach dem UmwHG steht ebenfalls noch aus. Die in Entwurfsfassungen vorliegenden Vorschlage der EGKommission fUr eine Abfallrahmenrichtlinie bzw. des Europarats fur ein europaisches Umwelthaf tungsrecht stellen noch tiefergreifende Reformen des UmwHG in Aussicht. Diese bevorstehenden Reforrnen andern nichts daran, daB de lege lata das UmwHG die maBgebliche Rechtsgrundlage der zivilen Umwelthaftung darstellt.
