El tema de la vivienda destinada a la residencia permanente, constituye en Cuba una prioridad fundamental. La transmisin de ste bien por causa de muerte, aparece regulado en la Ley General de la Vivienda, ya sea por la va testada como la intestada, donde se defiende primariamente el requisito de la ocupacin, para acceder a la titularidad de la misma, cuestin sta que ha sido aclarada posteriormente, en respuesta a situaciones de la vida prctica, no apareciendo claramente definido trminos necesarios e imprescindibles, para comprender el tema que se aborda, que acta en muchos casos como una limitacin a la autonoma de la voluntad privada y a su cumplimiento. Se incluye en la citada norma especial cubana el denominado requisito de la convivencia en relacin a las viviendas de residencia permanente, con el objetivo de proteger a los convivientes del causante, violando notablemente la voluntad privada del testador y dejando totalmente desprotegidas a aquellas personas que resultando igualmente ser los herederos del causante, no posean tal requisito. En este trabajo se hace un anlisis minucioso de los diferentes conceptos que se manejen por diversos autores y ciencias.
