El presente texto pretende dejar en evidencia la carga de ilegitimidad que soporta en el medio jurdico la figura del aborto, la cual, a travs de toda una construccin dogmtica que proclama estar soportada en los avances logrados por un derecho penal fundado a partir de posturas liberales, lo que parece esconder tras de s es una visin muy propia de lo femenino, que termina por crear ideologas inmutables como la imposibilidad de despenalizar el aborto teniendo en cuenta el carcter sacrosanto que constitucionalmente se ha construido en torno a la vida del embrin. Mediante un anlisis crtico desde el interior del propio discurso penal se intenta dejar clara la contradiccin en que incurre el derecho punitivo cuando trata de dar fundamento al aborto. Esto impondr, como consecuencia, presentar una idea de reconstruccin de lo femenino para, a partir de all, y del reconocimiento del derecho a la maternidad enmarcado dentro del concepto de la integridad corporal, entender que la accin de abortar no es una situacin que deba concernir al derecho penal, o no si, por lo menos, no quiere deslegitimar sus propios postulados.
