Habitualmente los trabajos que han versado sobre el proceso de mediacin se centran bsicamente en el problema del conflicto, sus elementos, el proceso de mediacin, el perfil del mediador, y cuando intentan responder a la pregunta cul es la materia transigible en la mediacin? lo hacen elementalmente, manifestando que lo transigible es lo renunciable. En complemento el presente libro, si bien analiza algunos conceptos bsicos, estudia cul es la materia que debe ser considerada transigible, pero con un especial enfoque, esto es la transigibilidad en el sector pblico. Es que, la intervencin del sector pblico en la mediacin afecta la dinmica de este mecanismo de solucin de conflictos. Varios factores coadyuvan a esta afectacin: el manejo de las potestades y prerrogativas de la administracin, la limitada capacidad del sector pblico que acta solo sobre las actividades expresamente permitidas, las exigencias para la creacin de compromisos presupuestarios, etc. En definitiva el presente trabajo intenta esclarecer cules son la expectativas que funcionarios pblicos y particulares pueden tener en un proceso de mediacin con el Estado.
