Lun des atouts du systme est doffrir aux titulaires de titres de proprit industrielle, une protection juridique dans lensemble des tats membres. Cependant, du fait que lOAPI ne forme pas encore un espace judiciaire pleinement intgr, la protection juridictionnelle attendue par les usagers reste encore rsiduelle. Cette lacune peut tre due labsence, lchelon rgional, dun mode centralis de rglement du contentieux de la proprit intellectuelle ou, plus gnralement, dun mcanisme dinterprtation uniforme du droit. La solution prconise par lauteur implique linstauration non seulement de tribunaux spcialiss dans les tats membres, mais aussi d'une juridiction communautaire en matire de proprit intellectuelle. Sur ce dernier point, une coopration institutionnelle avec la Cour de l'OHADA (CCJA) est envisageable. Mais dans tous les cas, une rpartition cohrente des comptences entre le juge national et ce futur juge rgional prviendrait les avatars actuels du systme de protection de Bangui.
