Il s'agit ensuite d'un consentement rvlant une participation criminelle ou consentement participatif. Il est un fait gnrateur de responsabilit pnale qui constitue, la fois, un critre de distinction entre la complicit et la coaction et un critre d'imputation de l'infraction commise en participation. Le consentement la mesure pnale entendu comme l'acceptation d'une mesure manant des autorits rpressives, au stade du procs ou de la sanction illustre, quant lui, une certaine justice consensuelle qui coexiste avec la justice pnale imprative, sans se confondre avec une justice ngocie ou contractuelle. Le consentement qui s'y rencontre emprunte les techniques de l'acte unilatral. Il s'agit, dans certains cas, d'un consentement abdicatif ou d'une renonciation, c'estdire un acte unilatral irrvocable, par lequel le justiciable abandonne un bnfice lgal (assentiment une perquisition, renonciation nullit...)
