Au regard de la circulation mondiale de linformation, cette absence dunanimit est regrettable car elle fragilise les efforts entrepris par les Etats soucieux de protger la vie prive. Dans un tel cas de figure et dans lattente dune acclration de la prise de conscience, il faut alors compter sur des mcanismes ordinaires issus du droit international priv ou, en cas datteinte grave, sur ceux prescrits par le droit pnal international. Toutefois, cette solution est loin dtre idale car elle subordonne la volont judiciaire au bon vouloir des Etats.
