Product DescriptionLa rcente affirmation par la Cour de cassation du principe d'universalit de la faillite et l'entre en vigueur le 31 mai 2002 du rglement communautaire sur les procdures d'insolvabilit ont marqu profondment le droit de la faillite internationale. L'accent est dornavant mis sur la reconnaissance d'un effet international la faillite : les procdures franaises pourraient apprhender l'intgralit du patrimoine du dbiteur quel que soit le lieu de situation des biens et inversement, les procdures trangres devraient pouvoir dvelopper leurs effets en France.Cet ouvrage, issu d'un colloque organis en mai 2004 par la Facult de droit de Rouen, a pour ambition de vrifier si cet effet international de la faillite n'est pas que de faade. C'est dans cette optique que sont tudies les dispositions gnrales (droit commun, droit communautaire), les instruments spcifiques certaines activits (entreprise d'assurance et tablissement de crdit), les rgles protectrices de certains cranciers privilgis, sans oublier l'irritante question de la comptence juridictionnelle ou celle du sort des groupes de socits.
