Dabei knpfte diese an die bestehende amerikanische "konomische Theorie des (Haftungs)Rechts" (TR) an. Betrachtete man die Zielsetzung des Haftungsrechts aus juristischer Perspektive, steht die Verteilungsfrage im Mittelpunkt. Bei dieser expost Betrachtung geht es darum einen gerechten Ausglich zwischen Schdiger und Geschdigten zu finden (Verteilungsfunktion). Aus konomischer Sicht hingegen liegt eine exante Betrachtungsweise zu Grunde. Das Verhalten des Schdigers soll im Vorfeld so beeinflusst werden, dass gar nicht erst Schden in unerwnschtem Ausma entstehen (Prventionswirkung). Durch das Haftungsrecht sollen somit Anreize geschaffen werden, die beim Verursacher zu Aktivitten fhren, mit denen die Eintrittswahrscheinlichkeit und das Ausma von Schden reduziert werden. Der Verursacher wrdigt somit die externen Kosten (Schadensersatz) in derselben Weise, wie die internen (Produktionsfaktoren). Man kann konomisch gesehen folglich bei Haftungsregeln von einer Strategie zur Internalisierung externer Effekte sprechen. In dieser Arbeit geht es darum, die Eignung des Haftungsrechts als umweltkonomisches Instrument zur Internalisierung externer Effekte herauszuarbeiten. Im Kapitel 2 folgt zu nchste eine Darlegung der Kernpunkte des deutschen Umwelthaftungsgesetzes (UmweltHG). Danach wird das konomische Grundmodell des Haftungsrechts mit seinen restriktiven Prmissen vorgestellt (Kapitel 3). Dabei erfolgt eine eigenstndige Betrachtung der Verschuldenshaftung (Kapitel 3.1.) und der Gefhrdungshaftung (Kapitel 3.2.). Im Kapitel 4 wird ein strkerer Realittsbezug hergestel
