Aber auch nach dem geltenden Deliktsrecht kann ein Minderjhriger selbst bei geringer Vorwerfbarkeit und Schuld fr einen von ihm verursachten Groschaden in vollem Umfang haftbar gemacht und mit einer erdrckenden Schuldenlast in die Volljhrigkeit entlassen werden. In der vorliegenden Arbeit werden mehrere Mglichkeiten untersucht, wie die deliktsrechtliche Haftung Minderjhriger im geltenden Recht eingeschrnkt werden kann. Im ersten Teil wird der bestehende Schutz Minderjhriger im Deliktsrecht dargestellt und geprft, ob dieser Schutz unter dem Gesichtspunkt des Minderjhrigenschutzgedankens sowie unter jugendpsychologischen und verfassungsrechtlichen Aspekten ausreichend ist. Im zweiten Teil werden die Mglichkeiten zur Erweiterung des deliktsrechtlichen Schutzes Minderjhriger im geltenden Recht untersucht. Der dritte Teil befasst sich mit einer Haftungsreduktion nach Billigkeitsgesichtspunkten gem. 242 BGB. Es wird dargestellt, wie die deliktische Haftung eines Minderjhrigen durch Anwendung des 242 BGB reduziert werden kann. Anschlieend wird geprft, welche Kriterien vorliegen mssen, um eine Haftungsreduktion vorzunehmen.
