Bei der Durchfhrung der Mitarbeiterkontrolle stellen sich spezielle individual und kollektivarbeitsrechtliche, aber vor allem auch datenschutzrechtliche Probleme. Insbesondere der Arbeitnehmerdatenschutz spielt eine ausschlaggebende Rolle. Mit dieser Arbeit wird der Versuch unternommen, rechtsgebietsbergreifend und umfassend die rechtlichen Grenzen arbeitgeberseitiger Kontrollen der Nutzung neuer Medien durch die Mitarbeiter darzustellen. Es erfolgt dabei eine Begrenzung auf die Informations und Kommunikationsmittel Telefon, Internet und EMail. Gegenstand der Arbeit ist nicht nur eine Darstellung, sondern auch eine kritische Wrdigung der derzeitigen rechtlichen Lage. Etwaige gegenwrtig bestehende Missstnde werden aufgezeigt und Lsungsanstze zu deren Behebung erarbeitet. Zudem werden sowohl die rechtlichen Sanktionen unzulssiger Kontrollen des Arbeitgebers dargestellt wie auch die mglichen arbeitsrechtlichen Folgen unerlaubter und bermiger privater oder missbruchlicher Nutzung betrieblicher neuer Medien durch die Mitarbeiter. About the Author Die Autorin: Andrea Panzer, geboren 1972 in Kln. Studium der Rechtswissenschaften an der RuhrUniversitt Bochum von 1992 bis 1997, Erste juristische Staatsprfung 1997. Nach einem mehrmonatigen Praktikum bei einer renommierten sdafrikanischen Kanzlei 1998 Beginn des Referendariates am Landgericht Bochum. Zweites juristisches Staatsexamen 2000, Promotionsstudium an der Universitt des Saarlandes, Promotion 2003. Seit 2000 als Rechtsanwltin zunchst im arbeitsrechtlichen Dezernat einer internationalen Grokanzlei und seit 2002 in einer ausschlielich auf Arbeitsrecht spezialisierten Kanzlei in Dsseldorf ttig.
