Das wirtschaftliche und gesellschaftliche System entwickelt sich immer dynamscher und ist durch Globalisierung und immer komplexere technische Vorgnge gekennzeichnet, was bereits zu verheerenden kologischen Schden mit Folgen fr Uwelt und Menschen fhrte. Seit Beginn der 70er Jahre ist die Umweltpolitik ein relevantes Thema der konomie. Die Studie "Grenzen des Wachstums" durch den "Club of Rome" machte erstmals einer breiten ffentlichkeit bewusst, dass der Vorrat an natrlichen Ressourcen nicht endlich ist. Die Gesellschaft wurde "wachgerttelt" und immer mehr Menschen weltweit entwickelten ein ausgeprgtes Umweltbewusstsein. Seither beschftigt sich die konomie als Wissenschaft systematisch mit der Entstehung und Beseitigung von Umwelproblemen und entwickelte das Aufgabenfeld der Umweltkonomik. Aus konomischer Sicht ist Marktversagen in Form von negativer externer Effekte und ffentlicher Gter das zentrale Argument fr staatliche regulierungsmanahmen zum Umweltschutz. (...) Da die Knappheit der Ressourcen nicht zu beseitigen ist, geht es darum, mglichst effizient zu handeln. Aufgrund dieser Eigenschaft des ffentlichen Gutes "Umwelt" werden keine Anreize geboten, sparsam mit diesem Gut umzugehen und der marktwirtschaftliche Selbstregulator versagt. Nach klassischer Auffassung ist es Aufgabe des Staates, diesen Mangel zu beheben und erforderliche Manahmen, wie beispielsweise Steuern, entsprechende Ge oder Verbote und auch Moral Suasion, zu ergreifen. Auf diese und anderen mgliche Instrumente der Umweltpolitik wird in Kapitel 2 nher eingegangen, wobei sich auf die Instrumente des Soft Law konzentriert werden soll.
