Product DescriptionDer postmortale Rechtsschutz ist ein aktuelles Problemfeld, das einerseits durch den medizinischtechnischen Fortschritt und andererseits durch ethische und rechtliche Fragen geprgt wird. Mit dieser Arbeit wird ein Verstndnis vom Rechtsschutz Verstorbener entwickelt, das rechtsgebietsbergreifende Geltung hat und das nicht als Antwort auf Fortschritte in der Medizin zu verstehen ist, sondern eine rechtlich sichere Basis fr den Umgang mit Verstorbenen darstellt. Es wird gezeigt, da das Recht Verstorbenen eigene Rechtspositionen einrumt. Damit besttigt sich die der Arbeit zugrunde liegende Hypothese einer postmortalen Rechtssubjektivitt. Bedeutung hat dieses Ergebnis u.a. fr die Neuregelung der Organspende und fr die Idee einer Prozepflegschaft fr Verstorbene.About the AuthorDer Autor: Knut Mller, 1968 in Hannover geboren, absolvierte das Jurastudium an der Universitt Passau, wo er seit 1994 auch als wissenschaftlicher Mitarbeiter ttig ist. 1995 Promotion.
