Los municipios estn subordinados a las provincias y son, para algunos especialistas: autnomos, es decir, que dictan sus propias normas y para otros: autrquicos, es decir, que se administran a s mismos sobre la base de normas generales dictadas por los niveles de gobierno superiores (las provincias y la Nacin). Desde que se comenzaron a legislar los regmenes municipales, hubo acuerdo en que los municipios deban ser autnomos. Pero surgieron distintas discrepancias sobre los alcances y los lmites de la autonoma, en relacin con el Estado Nacional y con los estados provinciales. El art. 123 de la Constitucin Nacional Argentina, establece que cada provincia dicta su propia constitucin, conforme a lo dispuesto por el art. 5 asegurando la autonoma municipal y reglando su alcance y contenido en el orden institucional, poltico, administrativo, econmico y financiero. Por un lado la Constitucin Nacional otorga autonoma a los municipios en el orden econmicofinanciero, pero por otro lado esta autonoma se ve restringida por los sistemas coparticipacin provincial. La autonoma tributaria amplia no asegura una autonoma de gobierno amplia.
