Seit Einfhrung des Gesetzes gegen gefhrliche Gewohnheitsverbrecher und ber Maregeln der Sicherung und Besserung vom 24.11.1933 wurde der Maregelvollzug stets als Aufgabe der Landeskrankenhuser angesehen. Seit Einfhrung des Grundgesetzes ist es den Lndern im Rahmen ihrer konkurrierenden Gesetzgebung gem. Art. 74 Abs. 1 Nr. 1 GG vorbehalten, den Maregelvollzug durchzufhren. Dies fhrt zu deutlichen Unterschieden in der Ausgestaltung des Maregelvollzugs der einzelnen Lnder. Fast unmerklich und ohne Erregung groen Interesses der Presse wurde Anfang des 21. Jahrhunderts der Maregelvollzug sowohl in MecklenburgVorpommern, in Thringen als auch in SachsenAnhalt privatisiert. Whrend die Privatisierung des Strafvollzugs stets ffentliche Debatten nach sich zog, wurde die ffentlichkeit auf die Zustnde im Maregelrecht erst nach den Beschlssen des AG Flensburg und zweitinstanzlich des LG Flensburg im Jahr 2005 aufmerksam. Es ist erstaunlich, dass sich die Privatisierung des hoheitlichen Maregelvollzugs in nahezu jedem Bundesland durchgesetzt hat, obwohl die bertragung hoheitlicher Aufgaben im Bereich des Strafrechts auf Private fast einstimmig abgelehnt wird. Mag es auch auf den ersten Blick selbstverstndlich erscheinen eine Privatisierung von Kernaufgaben' des Staates abzulehnen, so bedarf es dennoch einer umfassenden Prfung. Hinzu tritt, dass die materiellen Voraussetzungen der verfassungsrechtlichen Zulssigkeit einer Privatisierung bisher in keiner Entscheidung des Bundesverfassungsgerichts mageblich und abschlieend geklrt worden sind.
