Product Description Als 2005 in Brssel die Debatte ber eine mgliche Liberalisierung des Product Placement im Rahmen einer Revision der Fernsehrichtlinie begann, kam es zu heftigen Reaktionen gegen die Plne der EUKommission. Vertreter der ffentlichrechtlichen Fernsehsender und der Landesmedienanstalten, Verbraucherschutzverbnde sowie Politiker verwiesen auf die Gefahren, welche dies fr die redaktionelle Unabhngigkeit und die Zuschauer mit sich brchte und forderten ein Verbot von Product Placement im Fernsehen. Auf EUEbene zeigte man sich verwundert ber diese Aufregung. Schlielich ist Product Placement seit Jahren eine Realitt im europischen Fernsehen man denke nur an die zahlreichen USamerikanischen Serien und Kinofilme, die im Fernsehen ausgestrahlt werden und die zahlreiche Produktplatzierungen enthalten. Bei den jetzigen Vorschlgen ginge es lediglich um eine Anpassung der gesetzlichen Regelungen an die bisherige Praxis, denn auch in einigen EUMitgliedstaaten ist Product Placement bereits teilweise erlaubt. Angesichts der geplanten europischen Regulierung des bisher in Deutschland meist mit Schleichwerbung gleichgesetzten Product Placement errtert die Verfasserin seine Entwicklung, begriffliche Einordnung und Stellung in der kommerziellen Kommunikation sowie die verschiedenen Interessen und Anspruchslagen der wichtigsten Akteure. Nach einer Analyse ber die rechtliche Behandlung von Product Placement im Fernsehen nach der gegenwrtigen Regelung erfolgt eine Bewertung der geplanten Revision. Die vorgeschlagenen Regelungen zur Bildung eines Rechtsrahmens fr Product Placement im Kommissionsentwurf und die nderungsvorschlge des Europischen Parlaments werden in bersichtlicher Weise dargestellt und anschlieend einer kritischen Bewertung unterzogen.
