Der Kontext, in dem es zur Neudefinierung des Verhltnisses zwischen Staat und Indigenen kam, die Rolle und Tragweite der in der Konstitution verankerten Rechte und die Herausforderungen die sich daraus ergeben, sollen dabei besonders beleuchtet werden. Es gibt es ca. 800.000 Angehrige Indigener Vlker in Kolumbien, die 84 verschiedenen indigenen ethnischen Gruppen angehren. Dies sind ungefhr 2 3 % der Gesamtbevlkerung. Theoretisch besitzen diese indigenen Vlker ca. 25 % des gesamten kolumbianischen Territoriums, wobei es hier zwischen den verschiedenen Volksgruppen enorme Unterschiede gibt. Manche verfgen ber kaum gengend Land, um ihre eigenen Bedrfnisse durch die auf ihm vorhandenen Ressourcen abzudecken. Zudem kommt die erschwerte Zugnglichkeit dieser indigenen Territorien aufgrund ihrer geographischen Abgelegenheit. In Kolumbien ist in der Verfassung von 1991 festgelegt, dass die indigenen Vlker des Landes ein Recht auf Selbstbestimmung haben und ber ihre wirtschaftliche, soziale und kulturelle Entwicklung selbst entscheiden knnen. Somit wurde Kolumbien als multikultureller Staat verankert: Indigene Rechte existieren neben dem positivistischen Rechtssystem des kolumbianischen Staates und daraus ergibt sich ein Rechtspluralismus, der oft zu Konflikten und Widersprchen fhrt. Kolumbien besitzt laut Expertenmeinungen eine der fortschrittlichsten Verfassungen, was die Rechte der indigenen Vlker anbelangt.
