Einerseits scheint die darauf abzielende Norm 14 II Nr. 2 MarkenG deutlich geregelt zu sein. Andererseits weist jedoch die fr diesen Paragraphen verbindliche MarkenrechtsRichtlinie (Art. 5I 2 lit. b) darauf hin, dass die Verwechselungsgefahr nicht nur von den in 14 II Nr. 2 genannten Umstnden abhngt, sondern von einer Vielzahl von Umstnden und somit jeweils der Einzelfall zu bercksichtigen ist. Daher gestaltet sich die Beurteilung der Verwechselungsgefahr der durch die Marke erfassten Waren und Dienstleistungen wesentlich schwieriger, als der 14 II Nr. 2 MarkenG erahnen lsst.
