Habermas selbst hat die "Anwendung" theoretischer Begriffe, welche als eine Ergnzung durch die Kritik an gesellschaftlichen Tatsachen zu verstehen ist, immer wieder gefordert, in seinen politischen Stellungnahmen praktiziert. Diskurstheorie und Kritik bedingen sich gegenseitig. Die theoretischen Begriffe von Habermas fordern immanent den kritischen Blick auf die Tatsachen. In den jngsten Verffentlichungen zur Diskurstheorie des demokratischen Rechtsstaates und der Anerkennungskmpfe geht es ihm um die Rekonstruktion "des Geflechts meinungsbildender und entscheidungsvorbereitender Diskurse, in das die rechtsfrmig ausgebte demokratische Herrschaft eingebettet ist". (Habermas, 1992, 19) Die dadurch in diesen Diskursen erscheinende kommunikative Rationalitt gibt als normativer Begriff einen kritischen Mastab der gesellschaftlichen Mglichkeiten von Recht, Politik und Gesellschaft ab, "nach dem die Praktiken einer unbersichtlichen Verfassungswirklichkeit beurteilt werden knnen". (Habermas, 1991, 20) Begriff und Faktizitt sind nicht identisch. Die Gesellschaft als vernnftig begreifen heit noch nicht, da sie vernnftig ist. Habermas' theoretischem Rationalismus entspricht folglich ein auf die Tatsachen blickender Rationalittsskeptizismus. Die Verfassungswirklichkeit und faktische kommunikative Rationalitt schtzt auch Habermas skeptisch ein.
