Anhand von historischen Modellen anstelle ontologischer Kontinuitaten wird jenseits aller rechtsphilosophischen Spekulation die Leistungsfahigkeit des rechtsdogmatischen Wahrheitsbegriffs erortert. Den Ausgangspunkt bildet die infolge der kodifikatorischen Rechtspositivierung 1848 von Kirchmann angestossene Debatte uber die Wissenschaftlichkeit der Rechtsdogmatik, der bald jene uber die 1877 von Jhering in Frage gestellte Wahrheitsfahigkeit des Rechts folgte (Kap. I). Weil das Problem in der romischen Jurisprudenz der Prinzipatszeit wurzelt, wird im zweiten Schritt der von ihr vorausgesetzte Wahrheits und Wissenschaftsbegriff rekonstruiert (Kap. II). Den Schwerpunkt der Arbeit stellt die Analyse des enormen Quellenfundus der romischen Jurisprudenz dar, der traditionell nur unter dogmengeschichtlichen und kaum unter theoretischhistorischen Gesichtspunkten ausgewertet worden ist. Zum Zweck der geltungs und argumentationstheoretischen Auswertung wird im Zuge eines Gedankenexperiments angenommen, dass verum est uberall in den romischen Rechtstexten als 'wahr' zu verstehen sei. (Kap. IIIV). Es zeigt sich dabei, dass diese normative Wahrheit als Bilanzbezeichnung eines gegluckten rechtsdogmatischen Urteils verwendet wird und jeweils aus einem Bundel von Werturteilen besteht. Die Verwendung dieses undifferenzierten Wahrheitsbegriffs schmalert die Leistungsfahigkeit der Rechtsdogmatik, die in differenzierten Kategorien wie Anwendbarkeit, Wirksamkeit und Geltung zu denken aufhort (Kap. VI).
