Zwar konnte sich dieser Typ Werbung nicht als all gemeingltiges Mittel durchsetzen. Jedoch findet sich immer wieder Werbung mit schockierenden Inhalten wie die HIVKampagne der MichaelStichStiftung, die entsprechende Aufmerksamkeit erzielt. Ob diese Werbung in jedem Fall ihren angestrebten Zweck erfllt mag dahinstehen. Die vorliegende Arbeit befasst sich mit den Urteilen des Bundesverfassungsgerichts (BVerfG) und des Bundesgerichtshofs (BGH), welche sich mit der rechtlichen Beurteilung der Werbung mit schockierenden Inhalten von Benetton befassen. Dabei wird das Spannungsfeld zwischen den Grundrechten und dem Wettbewerbsrecht aufgezeigt. Die Arbeit macht den Einfluss der Grundrechte und des BVerfG, als Hterin der Grundrechte, auf das einfache Recht deutlich. Es wird zunchst die Gruppe der schockierenden Werbung in die Systematik des 1 UWG eingefat und anschlieend dieser Begriff nher betrachtet. Es folgt eine umfassende Darstellung der beiden Verfahren und der Argumente der entscheidenden Gerichte. Abschlieend wird zum Thema Stellung genommen.
