Die Errichtung des gemeinsamen Marktes wird mit Art. 2 EGV als eine der Hauptaufgaben charakterisiert und beruht auf einer immer engeren Verflechtung sowie Liberalisierung der Mrkte. Das Ziel besteht darin, mithilfe gemeinschaftlicher Handelspolitik bestehende Hindernisse und Beschrnkungen im zwischenstaatlichen Wirtschaftsverkehr zu beseitigen. So soll sich die Standortwahl fr Unternehmen und wirtschaftlich ttige Personen sowie die Ausbung ihrer Wirtschaftsttigkeit nach freien Marktbedingungen richten knnen. Dabei sind Strungen durch die Mitgliedsstaaten ebenso wie Strungen durch die Unternehmen selbst zu verhindern . Wettbewerbsverzerrungen knnen durch unternehmerisches Handeln, beispielsweise mit marktwidrigen Preisabsprachen, den Missbrauch einer marktbeherrschenden Stellung oder durch unlauteren Wettbewerb hervorgerufen werden. Desgleichen knnen die Mitgliedsstaaten durch die Gewhrung von Subventionen und Vergnstigungen (Beihilfen) den Wettbewerb beeintrchtigen. Die Art. 8189 EGV enthalten das Wettbewerbsrecht der Gemeinschaft. Sie sind damit Instrument des von Art. 3 Abs. 1 Buchst. g EGV geforderten Aufbaus eines Systems, welches den Wettbewerb innerhalb des Binnenmarkts vor Verflschungen schtzt . Die Wettbewerbsregeln der Art. 8186 EGV beinhalten die Vorschriften fr Unternehmen. Gegenstand der folgenden Betrachtungen werden die staatlichen Beihilfen und ihre Kontrolle sein, welche mit den Art. 8789 EGV geregelt sind.
