Product DescriptionDiese Arbeit befasst sich mit der Frage, ob Arbeitnehmerinnen und Arbeitnehmern in kirchlichen karitativen Einrichtungen ein Streikrecht zusteht. Ein besonderes Augenmerk gilt dabei der verfassungsrechtlichen Verankerung des kirchlichen Selbstbestimmungsrechts in Art. 140 GG in Verbindung mit Art. 137 Abs. 3 WRV, das dem Streikrecht der Beschftigten aus Art. 9 Abs. 3 GG entgegengehalten wird. Bei der Abwgung der Verfassungsgter kommt der Autor zu dem Schluss, dass zwar das Streikrecht durch das Verfahren des so genanntenZweiten Weges, nicht aber durch das Verfahren des so genanntenDritten Weges ausgeschlossen sein kann.
