Woraus ergibt sich die Legitimation, europaische Grundrechte zu schaffen? Wer wird durch sie berechtigt, wer verpflichtet? Diese unterscheidet drei Zeitabschnitte: die Zeit des ungeschriebenen europaischen Grundrechtsschutzes, die noch andauernde Zeit zwischen der Proklamation der Charta von Nizza und ihrer rechtsverbindlichen Verankerung im Europaischen Verfassungsvertrag und die Zeit nach dem InKraftTreten der EUVerfassung. Der Autor, Lehrbeauftragter der Universitat Regensburg, unterzieht den in der Literatur vertretenen Grundsatz der Parallelitat zwischen Regelungskompetenz und Grundrechtsschutzkompetenz einer kritischen Wurdigung. Er zeigt auf, dass die Charta der Grundrechte, die gegenwartig allgemein als unverbindlich gilt, bereits jetzt Auswirkungen hat. Der Vorrang der europaischen Grundrechte, die in ihnen enthaltenen Verweisungen auf das Recht der Mitgliedstaaten und auf europaisches Recht, das Fehlen eines europaischen Grundrechts der allgemeinen Handlungsfreiheit, die Frage, ob die Charta abschlieaenden Charakter besitzt, oder die Frage nach der Einfuhrung einer Grundrechtsbeschwerde auf europaischer Ebene sind einige der behandelten Themen.
