Jahrhunderts, Note: 1,9, GeorgAugustUniversitt Gttingen (Philosophische Fakultt), Veranstaltung: Rechtsphilosophie, Sprache: Deutsch, Abstract: Der Naturzustand bzw. das Naturzustandstheorem ist erst seit Hobbes die normativanalytische Basis der politischen Theorie; der Naturzustand als literarischpolitischer Topos ist lter. Bei Aristoteles ist der Naturzustand des Menschen durch das ideale und nicht nher hinterfragbare Dasein des Brgers in der Polis bezeichnet. Die kleinste gesellschaftliche Einheit bei Aristoteles ist der Haushalt. Das individuierte Einzelwesen ist hier nicht wichtig. Das Naturzustandstheorem hat bei Locke eine sehr viel komplexere Funktion als bei Hobbes. Der Naturzustand alle Menschen sind frei, rechtsgleich, privat und herrschaftstunabhngig stellt die positiven Strukturprinzipen der brgerlichen Gesellschaft als Normen heraus. Er ist, wenn auch als fiktive Abstraktion, bereits ein rechtlicher und politischer Zustand. Der "status civilis" ist lediglich ein abgeleiteter Zustand hiervon. Der Staat ist bei Hobbes konstituierend fr den gesellschaftlichen Funktionszusammenhang, bei Locke hingegen substituierend.
