Das knnten wir uns allenfalls als ein Paradoxon vorstellen oder vielleicht noch an eine tyrannische Staatselite denken, die sich unter dem Deckmantel der Demokratie an die Macht geputscht hat. Wie immer wir auch versucht sein werden, diesen Widerspruch einer nichtdemokratischen Demokratie zu lsen, eines scheint dabei fr uns prinzipielle Gltigkeit zu besitzen: in einer echten Demokratie herrscht einzig und allein das Volk. "Weit gefehlt!", knnte uns Peter Graf Kielmannsegg an dieser Stelle bereits entgegenhalten; "Unter den Staaten der Welt gibt es keinen, in dem das Volk im blanken Sinne des Wortes als Souvern herrscht und es hat auch keinen gegeben in den bald zweihundert Jahren seit der Proklamation der Volkssouvernitt durch die Franzsische Revolution" (Kielmannsegg, 1977: 9). Aber wer dann, mchten wir fragen? Wer "herrscht" in unseren Demokratien? Wo und wie ist die Souvernitt in (westlichen) Demokratien verankert? Wir wollen uns im Folgenden dem "Letztentscheidungsrecht", der Souvernitt, anhand von drei Realmodellen annhern: der Volkssouvernitt mit ihrem exemplarischen Realmodell der Schweiz, der Parlamentssouvernitt mit ihrem Realmodell "Grobritannien" und der Verfassungssouvernitt mit ihrem Realmodell der Bundesrepublik Deutschland. Im Mittelpunkt steht die Frage nach Demokratie, Freiheit und Recht im politischen Entscheidungssystem.
