Die Neuregelung des Umwelthaftungsreehts gehOrt zu den ehrgeizigsten umweltpoliti sehen Vorgaben der laufenden Legislaturperiode. Sie hat seit ihrer Ankiindigung in der Regierungserklarung vom Man 1987 eine lebhafte und kontroverse Diskussion in Wissensehaft, Wirtsehaft und Politik ausgelost, die aueh mit der Vorlage eines Ge setzentwurfs im Februar 1990 noeh Hingst nieht beendet sein wird. Das vorliegende Bueh ist aus einer Untersuehung entstanden, die das Institut fUr Okologie und Untemehmensruhrung im Jahre 1989 rur das Umweltbundesamt dureh geruhrt hat. Ergebnisse aus Workshops mit Versieherungen und Untemehmen, Konfe renzen und parallel laufenden Arbeiten des Instituts haben in den vergangenen zwei Jahren den MeinungsbildungsprozeB der Verfasser in vielfaltiger Weise angeregt und sieh in der Veroffentliehung niedergesehlagen. Teil A beruht im wesentlichen auf der Studie 'Empirisehe Untersuehung bisheriger Sehadensregulierungen im Umwelthaftungsreeht' (Forderkennzeiehen 101 06 037). Teil B wurde als okonomisehe Analyse versieherungstheoretiseher und praktiseher Aspekte einer Umwelthaftung vollstandig neu bearbeitet. Hinzugerugt wurde als Teil C eine synoptisehe Darstellung zum Stand der Reform des Umwelthaftungsreehts, die dem Leser die Orientierung in der vielstimmigen Diskussion erleiehtem soH. Die Veroffentliehung soH einen Beitrag zur Diskussion der Neuregelung des Umwelt haftungsreehts leisten. Absieht ist es, dureh dokumentierte und interpretierte Fakten sowie theoretisehe Uberlegungen die Bedingungen zu klaren helfen, unter denen die Umwelthaftung die gewiinsehten Ziele erreichen oder aueh verfehlen kann.
