Ziel der Untersuchung ist es, 4 Jahre nach Verabschiedung der Elektrizittsbinnenmarktrichtlinie und 2 Jahre nach Inkrafttreten des EnWG nachzuweisen, dass sowohl der europische wie auch der nationale Gesetzgeber einen Vorrang und Wertkonflikt zwischen den Zielen Umweltschutz und Wettbewerb in der Elektrizittsversorgung zwar gesehen aber nicht gelst haben. Beide, der nationale und der europische Gesetzgeber sind insoweit ihren selbst formulierten Ansprchen an eine moderne Gesetzgebung nicht gerecht geworden. Dies fhrt dazu, dass sich bereits jetzt Konflikte in der Verwaltungs und Rechtspraxis zwischen den widerstreitenden Zielen der Energieversorgung zeigen. Grtes Problem ist dabei nach Auffassung des Verfassers die erhebliche Rechtsunsicherheit im Rahmen von Durchleitungsbegehren, die gerade in einem Wirtschaftsbereich mit hohem Kapitalbedarf und langfristigen Investitionsentscheidungen als kontraproduktiv eingeschtzt werden muss.
