Product Description Die Arbeit wurde mit dem Hochschulpreis der Rechtsanwaltskammer Mnchen an der Universitt Passau ausgezeichnet. Anhand dreier exemplarischer Flle aus dem Bereich der Strafverteidigung beleuchtet der Verfasser die Frage, ob in bestimmten Situationen Schweigerechte von Zeugen im Strafprozess existieren, die weder in der StPO noch in Nebengesetzen normiert sind. Hierbei geht er auf Zeugen ein, die entweder ber die Inhalte mit ihren ehemaligen Strafverteidigern oder ber die Gesprchsinhalte mit ihren Rechtsanwlten bzw. sogenannten Zeugenbeistnden berichten sollen. In der Ausarbeitung werden die Lsungen auf Grundlage der existenten Anstze in Rechtsprechung und Literatur entwickelt. Abgelehnt wird in diesem Rahmen die unmittelbare Anwendung des Verfassungsrechts. Vielmehr wird eine Lsung im einfachgesetzlichen Bereich gesucht ( 68 a StPO). Letzteres auch, wenn sich z.B. der Strafverteidiger strafbar gemacht haben soll. About the Author Der Autor: Jens Bosbach, geboren 1974 in Kln, absolvierte zunchst eine Ausbildung zum Bankkaufmann. Anschlieend studierte er Rechtswissenschaften in Kln, Lausanne, Bonn und Mnchen. Das Erste und Zweite juristische Staatsexamen legte er in Bayern jeweils mit Prdikatsnote ab. 2007/2008 promovierte er an der Universitt Passau. Seit 2004 arbeitet er als Rechtsanwalt und ist seit 2007 auch Fachanwalt fr Strafrecht.
