Nach den mageren Ergebnissen der PISAStudien vergangener Jahre und einem zunehmenden globalen Wettbewerb steht die Bereitstellung einer guten bzw. besseren und umfassenderen Bildung auf der politischen Tagesordnung. Unsere Gesellschaft hat die Aufgabe, nachwachsenden Generationen Kenntnisse und Fhigkeiten zu bermitteln, mit denen sie spter die Herausforderungen des Lebens und des Arbeitsmarktes bewltigen knnen. Die Schule stellt dabei eine wichtige und zugleich reformbedrftige Ressource im deutschen Bildungssystem dar. Nach Artikel 7 Absatz 1 des Grundgesetzes steht das gesamte Schulwesen unter der Aufsicht des Staates. Dieser setzt wiederum Personen ein, die die heranwachsenden Generationen unterrichten: Lehrer. Sie gelten nach wie vor stereotypisch als Beispiel fr Beamte in Deutschland. Jedoch hat die heutige Industrie und Dienstleistungsgesellschaft dem Staat eine wachsende Flle von Aufgaben bertragen, die nicht zu den hoheitlichen Befugnissen im Sinne des eingangs zitierten Artikels 33 des Grundgesetzes gehren. So wird heute auch den Lehrern zum Teil nachgesagt, dass ihre Lehrttigkeit keine hoheitliche Aufgabe darstellt und schlussfolgernd der Beamtenstatus nicht notwendig bzw. berflssig ist. In dieser Arbeit soll der Frage nachgegangen werden, ob der Beamtenstatus bei Lehrern noch zu rechtfertigen ist oder ob es sinnvoller wre, jenen abzuschaffen. Zu Beginn meiner Arbeit werde ich zunchst erlutern, wodurch das Berufsbeamtentum im Allgemeinen gekennzeichnet ist, wie es sich im Laufe der Geschichte entwickelt hat und welche rechtlichen Komponenten zu bercksichtigen sind. Im Anschluss werde ich die aktuelle Situation der Lehrer am Beispiel des Bundesstaates Berlin darstellen. Dort
