Immer hufiger kommt es vor, dass Erblasser oder Schenker ber Vermgensgegenstnde im Ausland verfgen, einen Wohnsitz in einem anderen Staat haben, oder ihr Vermgen mangels eigener Kinder einem, in einem anderen Land lebenden, Verwandten vermachen. Die Mglichkeiten fr das Entstehen solcher internationalen Erbflle sind zahlreich, alle haben jedoch gemeinsam, dass sie die Steuerhoheit mehrerer Staaten berhren, was zu erheblichen Besteuerungsproblemen fhren kann. Erbschaftsteuerpflichtige Erwerbsvorgnge sind in Deutschland alle Erwerbe von Todes wegen, Schenkungen unter Lebenden, Zweckzuwendungen und in gewissen Zeitabstnden auch das Vermgen bestimmter Stiftungen und Vereine. Hinsichtlich der subjektiven Steuerpflicht unterscheidet Deutschland zwischen unbeschrnkter, erweitert unbeschrnkter, beschrnkter und erweitert beschrnkter Steuerpflicht, wobei vor allem die Inlndereigenschaft der am Erbfall beteiligten Personen ber die Art der daran anknpfenden Steuerpflicht entscheidet. Bietet ein Sachverhalt mehr als einem Staat Anknpfungspunkte fr eine Besteuerung, kann dies zu einer Doppelbesteuerung fhren, dem Kernproblem internationaler Erbflle. Eine Doppelbesteuerung kann auf unterschiedliche Arten entstehen: durch berschneidung subjektiver und objektiver, rein subjektiver, aber auch rein objektiver Anknpfungskriterien. Fr die Staaten besteht zwar keine Pflicht zur Vermeidung einer Doppelbesteuerung, dennoch halten dies fast alle Lnder fr notwendig und nehmen dementsprechend sowohl nationale als auch internationale Mglichkeiten in Anspruch um eine solche zu verhindern oder zumindest zu verringern.
