Vor allem soll geprft werden, ob und inwieweit bei einer gegen ein Kreditinstitut gerichteten Auenprfung Kontrollmitteilungen gefertigt und in welcher Art und Weise diese verwertet werden knnen. Die Arbeit beginnt mit einer genauen Themenabgrenzung, um die unterschiedlichen Ermittlungsmanahmen und die jeweilige Einschlgigkeit des 30a AO herauszuarbeiten (1. Teil). Im Rahmen der Untersuchung des Instituts der Kontrollmitteilung wird auf die Zulssigkeit der Anfertigung von Kontrollmitteilungen anllich einer Auenprfung im allgemeinen eingegangen und die vorhandenen Grenzen werden aufgezeigt (2. Teil). Im Anschlu daran wird der Frage nach den Kennzeichen des Bankgeheimnisses im allgemeinen und seiner Ausprgung im Steuerrecht im speziellen nachgegangen, um zu prfen, ob durch ein Bankgeheimnis im Steuerrecht die Ermittlungsmanahmen der Finanzbehrden absolut eingeschrnkt werden (3. Teil). Die Einschrnkung der Anfertigung von Kontrollmitteilung bei der Auenprfung einer Bank durch 30a Abs. 3 AO und sein Verhltnis zu 194 Abs. 3 AO werden dann vor allem im Hinblick auf die jngste Rechtsprechung des Bundesfinanzhofs zur Anfertigung von Kontrollmitteilungen bei Banken geklrt (4. Teil). Zum Schlu wird herausgearbeitet, wie Kontrollmitteilungen nach einer Auenprfung bei einer Bank verwertet werden knnen und welcher Rechtsschutz gegen die Fertigung und Verwertung besteht (5. Teil).
