A partir de diversas corrientes tericas de (o vinculadas a) la ciencia poltica, el trabajo trasciende a las perspectivas predominantes en los estudios de regulacin de servicios pblicos que se limitan a justificar las polticas regulatorias a partir del reconocimiento de las situaciones en las que el mercado no es el asignador ptimo de los recursos. En este sentido, y en base a aquellas corrientes tericas, emerge el concepto de capacidad de gestin estatal en la regulacin de servicios pblicos, entendida como la capacidad de las agencias reguladoras para controlar las actividades de las empresas privadas prestadoras de servicios pblicos, teniendo en cuenta la alta capacidad de stas para influenciar las decisiones regulatorias en favor de sus intereses dada la disparidad de recursos que poseen en relacin con los usuarios. A partir de un anlisis comparado de los servicios de telecomunicaciones, agua, gas natural y electricidad en Argentina entre 1990 y 2001, el trabajo explica, en un contexto de igual calidad institucional, el impacto de los diferentes grados de capacidad de gestin estatal en materia regulatoria sobre la proteccin de los derechos de los usuarios.
