Durch Amtsvormnder/pfleger und Berufsvormnder/pfleger wurden die Betroffenen zudem in den meisten Fllen nur anonym verwaltet. Mit einem Sachverstndigenbericht ber die "Lage der Psychiatrie in Deutschland" wurde Anfang der 70er Jahre erstmals eine breite ffentlichkeit auf diese Missstnde aufmerksam. Dennoch dauerte es fast zwanzig Jahre, bis schlielich eine Reform der alten Rechtslage durchgesetzt werden konnte. Das neue Betreuungsgesetz wurde in der Fachwelt mit einer groen Erwartungshaltung aufgenommen. Es strkt deutlich die Rechte des Betroffenen im Verfahren und zudem wird eine Betreuung nur in den Bereichen eingerichtet, wo eine Hilfe notwendig ist. Der Betreute soll soweit wie mglich sein Leben nach eigenen Vorstellungen gestalten knnen. Anders als zu Beginn befrchtet, konnte das Betreuungsgesetz in der Praxis gut umgesetzt werden. Regeln fr den Umgang mit hilflosen Menschen sind wahrscheinlich so alt wie die Menschheit selbst. Es spricht vielen dafr, dass die zentrale Problematik dieses Rechtsgebietes, nmlich das Spannungsfeld zwischen Frsorge und Entrechtung, genauso alt ist. Religise, kulturelle und soziale Wertvorstellungen, die einem stndigen Wandel unterliegen, bestimmen mageblich politische Entscheidungen, welche letztlich das mitmenschliche Verhalten vorschreiben. Die politische Gesellschaftsordnung bestimmt aber nicht nur die Regeln im Umgang mit kranken und hilfsbedrftigen Menschen, sondern sie definiert in entscheidendem Ausma auch, wer oder was als krank oder normal zu gelten hat.
