Die juristische Aufarbeitung der NS und der DDRVergangenheit brachte das unter der Oberflche des rechtlichen Alltags liegende Spannungsverhltnis zwischen Recht und Moral zutage. Das Problem des Spannungsverhltnisses zwischen Recht und Moral ist die Frage nach der Verknpfung beider Begriffe. Es ist daher zu klren, ob die beiden Begriffe miteinander verknpft sind, und spezifisch, ob das Recht die Moral impliziert oder ob Recht und Moral getrennt voneinander zu behandeln sind; erstere Position wre die der Naturrechtslehre, letztere die des sogenannten Rechtspositivismus. Ich mchte in dieser Arbeit der Frage auf den Grund gehen, wie der Rechtsphilosoph Gustav Radbruch in seiner nach dem 2. Weltkrieg entstandenen Philosophie dieses Spannungsverhltnis der Begriffe lst. Die Position Radbruchs ist deswegen interessant, da sie weder eine eindeutige Lsung zugunsten der rechtspositivistischen Position (Recht und Moral sind voneinander getrennt) noch zur aufklrerischen naturrechtlichen Position (Recht und Moral stehen in einer inhaltlichen Analytizitt) darstellt, sondern einen zwischen beiden Schulen differenzierenden Ansatz postuliert. Um die Frage, wie Radbruch das Spannungsverhltnis zwischen Recht und Moral lst, angemessen beantworten zu knnen, werde ich im Folgenden die beiden Schulen von Rechtspositivismus und Naturrechtslehre beleuchten, um sogleich auf Radbruchs zwischen beiden Positionen vermittelnden Ansatz zu sprechen zu kommen. Anschlieend werde ich die Philosophie Radbruchs anhand ihrer realrechtlichen Geltung in den Mauerschtzenprozessen diskutieren.
