Die vorliegende Arbeit geht der Frage nach, ob und unter welchen Umstnden die Entstehung eines Rechtssystems auch ohne staatliche beziehungsweise ohne eine bergeordnete Macht mglich ist. Dazu werden auf Basis konflikttheoretischer Modelle berlegungen zu einem Zyklus der Zentralisierungsgrade der Rechtsdurchsetzung angestellt. blicherweise wird in der Volkswirtschaftslehre davon ausgegangen, dass bestimmte Gter ffentlicher Art nicht effizient privat bereitgestellt werden knnen und demzufolge unter staatliche Lenkung fallen. Ein Rechtssystem zhlt ebenfalls dazu, weil hohe Kosten der Rechtsdurchsetzung und berwachung anfallen. Allerdings kann die Funktionsweise von Institutionen nicht immer mit den weitlufig verbreiteten Modellen erklrt werden. Ein Beispiel dafr ist die mittelalterliche lex mercatoria, bzw das ius mercatorum. Es handelt sich hierbei um ein Kaufmannsrecht, welches bindend fr alle Kaufleute und losgelst von jeglicher staatlicher oder obrigkeitlicher Bindung Jahrhunderte lang das vorrangige Rechtssystem der Kaufleute bildete. Die Besonderheit liegt in der dezentralen Entstehung dieses als Gewohnheitsrecht funktionierenden und von den Kaufleuten selbst durchgesetzten Ordnungsrahmens. Innerhalb der immer grer und intransparenter werdenden Gruppe von Kaufleuten erhielt sich, entgegen der blichen Annahmen, eine effiziente Selbstorganisation.
