Dieses in Artikel 50 der Charta der Grundrechte der Europischen Union (GRCh) verankerte strafrechtliche Justizgrundrecht ist mit dem Vertrag von Lissabon Bestandteil des unionalen Primrrechts geworden. In fnf Fallgruppen untersucht die Arbeit den Anwendungsbereich der Norm sowohl auf dem Gebiet des Kriminalstrafrechts als auch dem des Strafrechts im weiteren Sinne. Unter Heranziehung der Grundstze des 84 OWiG wird eine ausdifferenzierte Systematik entwickelt, die die Anwendung des Art. 50 GRCh in allen denkbaren Kombinationen von Erst und Zweitsanktionen regelt. Dabei werden auch solche Doppelbestrafungskonstellationen bercksichtigt, die erst drohen, wenn in Zukunft originres europisches Kriminalstrafrecht gesetzt wird.
