Derzeit mehren sich die Kritik an den Regelungen der Verpackungsverordnung sowie die Vorschlge zu deren nderungen. Dabei ist auch die wettbewerbsrechtliche Dimension der Entsorgung von Verkaufsverpackungen wieder vermehrt diskutiert worden. Die vorliegende Untersuchung befat sich im wesentlichen mit der kartellrechtlichen berprfung des Systems der DSDAG als bisher sichtbarster Erscheinungsform der Umsetzung des Konzepts der abfallrechtlichen Produktverantwortung. Sie sucht in diesem Rahmen jedoch auch eine Antwort auf die Frage, inwieweit die festzustellenden wettbewerbsrechtlichen Probleme der Produktverantwortung selbst immanent sind, sich aus deren rechtlicher Umsetzung in Form der Verpackungsverordnung ergeben oder lediglich dem wettbewerbswidrigen Verhalten der beteiligten Wirtschaftskreise zuzuordnen sind. Anhand eines Vergleichs mit dem Lsungsansatz in Grobritannien wird gezeigt, da die wettbewerbsrechtlichen Probleme nicht zwingend aus der Idee der Produktverantwortung folgen, und da die zugrundeliegende Idee, Umweltschutz durch Wettbewerb zu erreichen, umsetzbar ist. Die Arbeit zeigt auf, da die Absicht der abfallrechtlichen Produktverantwortung, konomie und kologie im Wettbewerb in Einklang zu bringen, bislang nicht umgesetzt wurde, und da die bisherige Umsetzung wettbewerbsfeindlich ausgestaltet ist.
