S. ihrer formellen oder materiellen Vereinbarkeit mit dem Grundgesetz (GG), sondern um die Frage, ob und wieweit eine an sich verfassungsrechtlich nicht zu beanstandende unterverfassungsrechtliche Normsetzung (einfache Gesetzgebung) so auf das Verfassungsverstndnis, insbesondere das der Grundrechte, rckwirken kann, da es mglich ist, von einer faktischen Verfassungsnderung ohne vernderte Verfassungsurkunde zu sprechen und ob sich ggf. hieraus Zulsssigkeitsgrenzen fr den einfachen Gesetzgeber ergeben. Damit verbunden ist die Frage nach der 'Elastitt' der Verfassung bezogen auf den stndigen gesellschaftlichen Wandel, d.h. inwieweit sich objektive und subjektive ( Stichwort 'Wertewandel' ) Vernderungsprozesse, die sich auch in der einfachen Gesetzgebung widerspiegeln, zulssiger oder notwendigerweise im Verfassungs, insb. aber auch im Grundrechtsverstndnis niederschlagen knnen. Zu prfen ist somit, ob es eine unzulssige 'schleichende Verfassungsnderung' auch im Grundrechtsbereich und damit evtl. die Wesensgehaltsgarantie des Art 19 Abs. 2 tangierend durch einfache nicht verfassungsndernde Gesetzgebung gibt und wie ihr ggf. zu begegnen ist. Das hier zu errternde Problem ist ein verfassungstheoretisches, aber auch verfassungspolitisches, da sowohl die Analyse als auch Lsungsvorschlge aus dem zugrunde liegenden Demokratieverstndnis folgen.
