Talcott Parsons etwa wUrdigt die Rechtssoziologie deshalb als 'Kern der substan tiellen Soziologie' Webers, weil sie dem 'KernstUck des so zialen Systems', der normativen Ordnung, gewidmet sei; und wenn Parsons davon spricht, daB in Webers Analyse der Konflikt von 'Idealfaktoren' und 'Realfaktoren' gelost sei, so laBt er keinen Zweifel daran, daB diese Losung eindeutig zugunsten der ersteren erfolgt: das Recht ist fUr ihn die wirksame nor mative Ordnung, deren 'tiefere Bedeutung' sich letztlich nur in einer 'Analyse der kulturellen Systeme' entschlUsselt (1). JUrgen Habermas thematisiert die Rechtssoziologie zwar als ambivalent, doch sieht er die Ambivalenz lediglich im Wider streit zweier normativistischer Ableitungen des Rechts: einer solchen, die das Recht als 'Verkorperung moralischpraktischer BewuBtseinsstrukturen' faBt, und einer anderen, die es als Institutionalisierung der kognitivinstrumentellen Rationali tat konzipiert (2). In kritischer Absicht erscheint diese Interpretation auch bei Georges Gurvitch, fUr den sich die Rechtssoziologie im wesentlichen darauf beschrankt, die RUck wirkungen der Dogmen und Normensysteme auf effektive Ver haltensweisen zu erforschen.
