Bestrafung wegen derselben Tat ist nicht allein grundgesetzlich (Art. 103 Abs. 2 GG), sondern zugleich vlker (Art. 14 Abs. 7 IPbpR) und europarechtlich (Art. 4 Protokoll Nr. 7 zur MRK) abgesichert. Im transnationalen Bereich hufen sich in zunehmendem Mae die praktischen Probleme, wie sich eine rechtskrftige Aburteilung in einem Erstverfolgerstaat auf die Strafverfolgung im Zweitverfolgerstaat auswirkt. Innerhalb der Europischen Union gibt es mittlerweile ein solches Verbot der Mehrfachverfolgung bzw. bestrafung in Art. 54 SD eine zentrale Regelung, die einerseits den Strafverfolgungsbehrden mancherorts noch unbekannt zu sein scheint, deren Fortentwicklung wiederum andererseits von der Strafrechtswissenschaft angestrengt wird. Grundvoraussetzung fr die Anwendbarkeit von Art. 54 SD ist das Vorliegen derselben Tat'. Die beiden wichtigsten Fragen im Zusammenhang mit dem Tatbegriff gehen dahin, wieweit die angeklagte/abgeurteilte Tat reicht (Umfang der Tat) und wann eine Tat ungeachtet einiger Unterschiede in Tatort, Tatzeit und/oder Deliktscharakter noch mit der angeklagten/abgeurteilten Tat (Identitt der Tat) bereinstimmt. Whrend zum ersten Themenkomplex bereits eine Flle von nationaler und internationaler Literatur ergangen ist, gibt es derweil erst wenige Beitrge zu der Tatidentitt in Art. 54 SD. Die vorliegende Begutachtung nimmt sich dieses letztgenannten Gesichtspunktes an und erlutert nach einer einfhrenden vergleichenden Betrachtung des prozessualen Tatbegriffs, wie er seit 1871 von der deutschen hchstrichterlichen Rechtsprechung aufgefasst wird die Grundstze der erst jngst ergangenen Rechtsprechung des Europischen Gerichtshofes.
